Running a business comes with real operational pressures, especially with rising overheads like winter power bills. However, how employers address these challenges makes all the difference when it comes to workplace culture and New Zealand employment law.

A story by 1News highlighted a situation where early childhood centre staff were warned their wages could be docked over heat pump usage to curb rising utility expenses.

I was asked to provide commentary on the legal realities of this situation for the piece:

"The threat to deduct money from employees' wages due to an increase in heating costs is unlawful as the circumstances are not reasonable, there is no written consent from the employees, and it is only for the benefit of the employer... A fair and reasonable employer would seek other ways to combat the issue. Threatening employees is neither ethical nor legal."  

Under the Wages Protection Act 1983, arbitrary or unilateral deductions from an employee’s pay are unlawful. While keeping operating costs manageable is a valid business objective, passing operational overheads directly onto staff through wage threats exposes businesses to personal grievances and erodes team trust.
